TerraVex Acceptable Use Policy (AUP)

This policy is incorporated into the Terms of Service (https://app.terravexos.com/legal/terms). "AI Features" has the meaning given in Section 1.7 of the Terms, and "Pesticide Laws" has the meaning given in Section 1.12 of the Terms. You and your Authorized Users must not use the Service to, or attempt to:
1. Legal & rights violations
- Violate any law or regulation, or infringe intellectual-property, privacy, publicity, or contractual rights.
- Use the hiring and onboarding tools to ask for information the law does not allow you to request, to ask for more or different employment-eligibility documents than the law allows, or to discriminate against an applicant or Team Member.
- Upload or transmit content you lack the rights or consents to use.
- Upload Social Security or taxpayer identification numbers, tax forms (such as a W-2, W-4 or W-9), Form I-9, government ID images, or payment card or bank account numbers; the Service is not designed to hold them.
- Record voice or video without any legally required notice/consent, or violate wiretap, biometric, or eavesdropping laws.
- Order or use a background check or drug screen without a permissible purpose, the required disclosures and authorization, or the adverse-action steps the law requires.
1A. Pest control records and reports
- Create, alter, backdate or falsify an application record, inspection report (including a wood-destroying organism report), service record, notification or posting record, or any other record or report that Pesticide Laws require, or delete one you are required to keep without first keeping a copy.
- Issue a report or record in the name of, or under the license or certification number of, a person who did not perform or supervise the work, or let an unlicensed or uncertified person perform work the law reserves to a licensed or certified applicator.
- Use the Service to recommend, schedule or record an application that is inconsistent with the product label, uses a product not registered for that use in that state, or uses a restricted-use pesticide without the required certification.
- Present any report, estimate, or output of the Service as having been inspected, certified, approved or signed by TerraVex.
2. Communications abuse
- Send SMS, calls, or email in violation of anti-spam, telemarketing, or consent laws (for example the TCPA, CAN-SPAM, CASL), or without required opt-ins and opt-outs.
- Send marketing texts to anyone whose consent to marketing texts is not recorded, or outside 8 AM to 8 PM in the recipient's local time.
- Send unsolicited bulk or deceptive messages, or spoof sender identity.
3. Security & integrity
- Circumvent or probe authentication, authorization, tenant isolation, rate limits, or other security controls.
- Access data, accounts, or workspaces you are not authorized to access, or attempt to access another tenant's data.
- Introduce malware; scrape, crawl, or harvest data except through provided APIs within limits; or perform load/penetration testing without prior written authorization.
- Interfere with or disrupt the Service, its infrastructure, or other users.
4. Platform & AI misuse
- Reverse engineer, decompile, or derive source code except as law permits.
- Use TerraVex's Confidential Information, non-public documentation, or the AI Features' model outputs to develop a competing product, or extract, replicate, or train on model weights or outputs beyond permitted use.
- Use AI Features to make solely automated decisions with legal or similarly significant effects on individuals without human oversight and required safeguards, or in a discriminatory manner.
- Use AI output to choose a product, rate, site or method of application, or to complete an inspection report or application record, without review by your licensed personnel.
- Submit prohibited, unlawful, or unnecessarily sensitive content to AI Features.
5. Fraud & financial abuse
- Use payment features to process fraudulent, unauthorized, or prohibited transactions, launder money, or evade fees, chargebacks, or platform application fees.
- Misrepresent invoices, estimates, taxes, services performed, or your identity, licenses or authority.
6. Content
- Upload content that is unlawful, harmful, harassing, defamatory, or that exploits or endangers others.
7. Enforcement
We may investigate suspected violations and may suspend, restrict, or terminate access (including at the platform level) where reasonably necessary to protect the Service, other customers, or third parties, or to comply with law, as described in Sections 12.2 and 12.3 of the Terms of Service. We will use reasonable efforts to give notice by email where practicable, and a suspension never removes your ability to export your data. Report abuse to security@terravexos.com or support@terravexos.com.
8. Content complaints and takedown
If you believe content on the Service or on terravexos.com is defamatory, infringes a copyright, trademark, trade name or trade secret, or otherwise violates your rights, email legal@terravexos.com (or support@terravexos.com) with: the content and where it appears (a link or screenshot), the right you say it violates, your contact details, and a statement that you believe in good faith the use is not authorized. We acknowledge complaints within two business days and, where the complaint is reasonably founded, remove or disable access to the content within five business days, tell the customer or user who posted it, and give them a chance to respond. Repeat infringers lose access. Copyright notices under the DMCA may be sent to the same address; counter-notices are handled the same way. Where the content is a customer's own record inside their private TerraVex account (for example a note on a job or an inspection finding), we ask that customer to correct it and act ourselves only if they do not.
